This Legal Declaration regulates the access and use of the various contents and services included or accessible through Roche's websites for Central America and the Caribbean through the companies Productos Roche (Panama), S.A. and Productos Roche Guatemala, Sociedad Anónima. The companies of Central America and the Caribbean are part of the Roche Group, which all together are now known as "Roche").

By the mere use of the website or system you acquire the status of user. The use of the website or system (hereinafter "the site" and/or "the sites") and any of the services thereof means your acceptance as a user, without reservation of any kind, of each and every one of these general conditions, as well as to the particular conditions that, if applicable, are considered in force. Also applicable to the Site, the provisions included in the Privacy Policy.

The products included in "the site" are understood exclusively for health professionals, when they review this condition under the laws of country. Under no circumstances should product information be considered to be addressed to a different public.

It is important that healthcare professionals who have access to the site consider that all material contained herein, specifically that directed at such professionals, is included with the sole purpose of having additional reference information regarding advances in the world of medicine.

Roche is not responsible in any way for the decisions or actions taken on the basis of the content of the information contained on the Site, and it cannot be taken in any way as final or specific advice, since the particular conditions in the case to which it intends to be applied may change or be different. Any use and/or application of the information contained on the site shall be the sole responsibility of the person who applies such information.

Specifically by the Marketo system, Roche can send emails from the application to third-party information in Roche's database and the way it collects data. A tracking pixel and a tracking ID are automatically embedded in the email. In this case, the information collected does not involve any personal or sensitive data of the user or third parties. The information collected and its purposes are primarily to improve the quality of customer service and the emails to be sent are aligned with the purposes contained in the Personal Data section of this Legal Notice. Resource usage

The user undertakes, in general, to use the site as well as the services linked to it diligently, in accordance with the law, morality, public order and the provisions of this Legal Declaration, and must also refrain from using them in any way that may impede the normal functioning and enjoyment by users of the site of the services linked to it , or that could injure or cause damage to the property and rights of ROCHE, its suppliers, users or, in general, any third party.

More particularly, but without this enumeration limiting the general scope of the obligation set out in the preceding paragraph, the user undertakes to use the site and the services linked therein, to:

(a) Do not introduce, store or disseminate through the Site or through any of the services linked therein any computer program, data, virus, code, or any other electronic instrument or device that is likely to cause damage to the site, to any of the services linked to it or to any ROCHE equipment, systems or networks, of any user , from its suppliers or in general from any third party, or otherwise capable of causing them any kind of alteration or preventing the normal functioning of the same.

Cookies

ROCHE may use "cookies" in order to facilitate navigation and offer a personalized and more agile service. If the user does not want a "cookie" installed on his/her hard drive, he/she must configure his/her Internet browsing program to not receive them. Likewise, the user may destroy the "cookies" freely. In case the user deletes the "cookie", the quality and speed of the service may decrease.

Personal data

The user declares that the personal data provided are voluntarily delivered. You also acknowledge that all or part of this information may be classified as sensitive data. The user expressly authorizes that all the information I have delivered be subject to processing in a data bank by Roche. All data will be processed under the strictest confidentiality policies, collected and discarded in accordance with applicable regulations. Roche in turn informs that personal data is collected for the purpose of:

1. Create databases for statistical purposes, including access to operating data to proactively identify the performance of the instruments
2. Invite you to participate in events, scientists, commercials and others generated by Roche,
3. Address and respond to your request for information,
4. Send you information and/or promotional material about our products and/or scientist
5. Creating support requests
6. Customer Satisfaction Surveys
7. Provide after-sales care and support, among others related to the services provided to the customer.

The user has the rights of access to the data provided, rectification (of incorrect or inaccurate data), deletion and revocation (revoke this consent when deemed relevant) which must request the following email address: [email protected], and any management will be resolved within the period granted by the legislation. The rights of deletion and revocation will in any case be subject to Roche's need to maintain the data only to pursue purposes of fulfilling outstanding obligations.

Personal data will not be sold or transferred to third parties, national or foreign, who are unrelated to or act in accordance with Roche's instructions, if your prior consent is not available. Roche may transfer your sensitive personal and/or personal data to third parties, nationals or foreigners, who do not act on behalf of and on behalf of Roche, only when such transfer is provided for and authorized by law, as well as when necessary to fulfill the purposes of the business and described in the Privacy Notice made available to you.

APPLICABLE LAW AND JURISDICTION

These Terms of Use are governed in their entirety by Panamanian law and any disputes that arise in connection with them will be resolved in the Panamanian courts.

The User agrees to submit to the jurisdiction of the Panamanian courts, in any legal process or action.
